1. Terms of Service

1.1 Agreement

This Terms of Service are an agreement between you (either an individual or an entity), and mCoDev Systems regarding use of this site, its sub-sites and services. By using any of our services or websites, you agree to be bound by the terms in this agreement. If you do not agree with one or any of these terms, leave this site now and cease any use of our services or products immediately.

1.2 Copyright Statement

Unless otherwise stated, all materials on this website are property of mCoDev Systems. Any unauthorized copying of this site (including images, sounds, text, design, documentations or any portion thereof) without written authorization is an infringement of the copy law and may result in severe civil and criminal penalties and will be prosecuted to the maximum extent possible under law.

1.3 Term of Agreement

mCoDev Systems reserves the right to update these terms without prior notice. You should check this page from time to time to stay updated.

1.4 Public Social Areas

1.4.1 Forums, blogs, chats or other message areas (“Social Media”).

You agree not to use these Social Media to post any material which is vulgar, defamatory, inaccurate, spam, harassing, hateful, threatening, invading of other’s privacy, unlawful, flaming, criticizing or violates any national or international laws and/or posts that contain viruses or harmful components. You also agree that you will not post any copyrighted material that is not owned by yourself. By submitting messages to the Social Media, you represent to mCoDev Systems that you are the rightful owner of such material or that you have first obtained permission from the rightful owner to post such material. Piracy is not allowed, and mCoDev Systems will enforce a zero tolerance policy on our network.

You remain solely responsible for the content of your messages, and you agree to indemnify and hold harmless mCoDev Systems and their agents with respect to any claim based upon any post you may make.

Although messages posted are not the responsibility of these Forums and mCoDev Systems is not responsible for the content or accuracy of these messages. If you do find any posts are objectionable, then please contact mCoDev Systems (Contact Form). Furthermore, mCoDev Systems reserves the right to delete any message and to ban or kick anyone if we feel our Terms of Service have been violated.

Some services allow more things or restrict other content. You should always check the services terms before using it.

1.4.2 Accounts

mCoDev Systems gives you the ability to register on our communities and to meet up with people online. However, when you create an account, you are responsible for it and anything that happens with your account, if it’s being used in purpose to violate these Terms of Service, your account will may get terminated.

1.4.3 Termination and End-Of-Life

It is possible that in the future, mCoDev Systems may end a Social Network on our service. In case we decide a network is not viable any more, or we no longer want to spend any resources to keep a network running on our servers, we will inform every user currently using that network of the approaching end-of-life several weeks ahead of shutdown, so that users are able to migrate to a different server (if this possible) and/or save their data.

All our services and products are provided “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MCODEV SYSTEMS AND ALL ITS AGENTS FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THESE SERVICES REMAINS WITH THE RECIPIENT. ALSO, MCODEV SYSTEMS AND ITS AGENTS CANNOT BE HELD RESPONSIBLE FOR ANYTHING THAT MIGHT HAPPEN ON OUR SERVICES. INTERACTION WITH OTHER MEMBERS OR GUESTS OF THIS SITE IS AT YOUR OWN RISK.

1.6 Use of our Game Servers

1.6.1 Our Goals

Part of our services is aimed at online gaming. We have several servers online where players from around the world may connect to. While connected to these servers, you are bound by the Terms of Service and Privacy Statement above, as well as any addition terms described below.

We aim to make the gaming experience fun and enjoyable for each and every user, regardless of race, ethnicity, believes (political or spiritual), orientation, skill level, social status or anything that may identify a person. Therefore, you shall not discriminate against other players, use hateful or insulting speech, and you will keep the chat free of unnecessary content aimed to attack a person or our any of our services.

1.6.2 General Rules

You shall not upload and use content (in form of sprays) or create things that are in violation of our Terms of Service, you shall not hammer our service and flood the chat with spam messages or messages to attack a person or entity. You shall not grief other players. You shall not use cheats, hacks or exploits. And, you shall not disrespect an admin (or any other player) on any of our servers.

Breaking any of these rules may result in a kick from the server and a ban. Bans are network wide. This means, if you get banned on one server, you will get banned on all the servers. You may appeal your ban using our forums if you feel your ban is unjustified, and we will evaluate your request and investigate our log files.

In short, be nice and keep it fun for everyone.

1.6.3 Limitations

Our servers are located in Antwerp, Belgium. For high pace games such as Team Fortress 2 or Counter-Strike, we enforce users to have a reasonable ping count when connected to our servers. If your ping is too high, then perhaps it is better to find a server that is nearer to you. We generally do not discriminate against people from other locations, but you must know that playing with a high ping causes problems for other players, and it’s generally not fun to play against players that are rubber-banding from one position to another, just because of their high latency.

Therefore, we have decided that players with a latency higher than 110ms will be kicked from high-paced game servers, and players with a ping higher than 200ms will be kicked from other game servers.

2. Privacy Statement

This privacy statement describes how mCoDev Systems collects and uses personal information from our clients through any of our services. It is committed to respect our clients’ privacy, as it is our goal to make your visits as safe and enjoyable as possible.

2.1 Children’s Privacy

mCoDev Systems does not collect personal information from guests under the age of 13. Parents or legal guardians that find that their children have given personal information in accessing any part of the mCoDev Network, may request to destroy this information by sending an e-mail to the administration desk. If you are below the age of 13, please do not register an account or use any parts of this website that requires personal information.

2.2 General privacy & GDPR

Unless otherwise stated, all information that mCoDev Systems collects will not be passed on to any third parties. For citizens of the European Union, GDPR requires us to explicitly tell you what data we collect and how we store such data.

The data that we collect are generally the user data that you provide on registration forms and on the member account information area. This data is stored on a database machine which is inaccessible from the outside world.

If you feel that this data is incorrect or should not be stored in our database, you can send us a request to destroy any data related to you. This will however make you unable to use any member-exclusive areas on our websites or services.

2.3 IP Addresses

Our services collect IP addresses for administrative and logging purposes. An IP address is a unique number that is assigned to your computer or network whenever you surf the World Wide Web. mCoDev Systems does not normally link or lookup IP addresses. This means a guest accessing any of our services will remain anonymous. However, mCoDev Systems reserves the right to use your IP address to identify you when we feel it is necessary to enforce compliance with our Terms of Service in order to protect our services and all of its clients.

mCoDev Systems also reserves the right to reveal whatever information we know about you in the event of a complaint or legal action arising from any message posted by yourself.

2.4 Use of cookies and local storage

Some parts of this website use cookies to remember your last settings. For example, when asked to log in to this website, a cookie or session token will be saved with your session information so that when you enter the next time, you won’t have to log in again. This website does not use any cookies utilized by third parties.

2.5 Forums, Social Media and Message Centres

When you submit information to communication components, such as forums, chats and message boards, it will be viewable by the public. mCoDev Systems further disclaims all responsibilities for any personal information you might submit to any public area on our network. You can make a request with us to remove information that you have posted or someone else has posted about you, by contacting an operator of the service, or mCoDev Systems administration (see contact page).

2.6 Links to other sites

Be aware that mCoDev Systems may redirect you to other sites that might be beyond our control. There are several links that might direct you outside the scope of our services. These websites and services might send their own cookies and may collect personal information as well. You should refer to their Terms of Service and Privacy Statement for more information.
